Terms of Sales
These conditions of sale are concluded on the one hand by the SARL MENS CLUB whose registered office is in Paris 75011 at 60 Avenue Philippe AUGUSTE, registered in the trade and companies under the number 391 191 392 and whose telephone is: 00 33 (0)1 42 50 00 61 hereinafter referred to as MENS and on the other hand, by any natural or legal person wishing to make a purchase via the website.

The sale of poppers is strictly prohibited for minors and is also prohibited in certain countries; please check the current legislation of your country.

Object

These conditions of sale are intended to define the contractual relations between MENS and the buyer and the conditions applicable to any purchase made through the merchant site of MENS, whether the buyer is professional or individual costumer.
The acquisition of a good or service through this website implies unreserved acceptance by the buyer of these conditions of sale.
These conditions of sale will prevail over any other general or specific conditions not expressly approved by MENS.
MENS reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer. Characteristics of the goods and services offered
The products and services offered are those that appear in the catalog published on this site. These products and services are offered while stocks last.
A description established by the supplier is joined to each product ; for some of them, marked DF, the buyer can have access to the supplier's documentation.
The photographs in the catalog are as faithful as possible but cannot ensure perfect similarity with the product offered, particularly with regard to colors.

Prices
The prices appearing in the catalog are prices in euros included french tax, taking into account the VAT applicable on the day of the order; any change in the rate may be reflected in the price of products or services.
MENS reserves the right to modify its prices at any time, it being understood that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer.
The prices indicated include (or do not include) the costs of order processing, transport and delivery provided that they take place in the geographic areas provided below.

Geographical area
The online sale of products and services presented on the site is reserved for buyers who reside in France, in th French overseas departments and territories or in Monaco or any other country in which the products concerned are not subject to any legal prohibition and for deliveries required in these geographic areas.

Orders
The buyer who wishes to buy a product or service must:
- fill in the identification form on which he will indicate all the contact details requested or give your customer number if you have one
- complete the online order form giving all the references of the products or services chosen;
- validate the order after having checked it;
- make the payment under the conditions provided;
- confirm the order and payment.
The confirmation of the order implies acceptance of these conditions of sale, the acknowledgment of having perfect knowledge of it and the renunciation of availing oneself of its own conditions of purchase or other conditions. All the data provided and the confirmation recorded will constitute proof of the transaction. Confirmation will be worth signing and acceptance of transactions. The seller will send confirmation of the recorded order by email.

Withdrawal
Buyers, non-professional individuals, benefit from a withdrawal period of fourteen days from the delivery of their order to return the product to the seller for exchange or refund without penalty, except for return costs.

Payment terms
The payment must be done at the validation of the order.
Payments will be made by bank cards; they will be carried out through a secure system which uses the SSL (Secure Socket Layer) protocol so that the information transmitted is encrypted by software and that no third party can become aware of it during transport over the network.
An invoice will be attached to each package. For wholesale orders, a payment period can be granted, contact us.

Deliveries
Deliveries are made to the address indicated in the order form which can only be in the agreed geographical area.
The risks are borne by the purchaser from the moment the products have left the premises of MENS In the event of damage during transport, the reasoned protest must be made to the carrier within three days of delivery.
Delivery times are given for information only; if these exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed.

Guarantee
All products supplied by the seller benefit from the legal guarantee provided for in articles 1641 and following of the Civil Code.
In case of nonconformity of a product sold, it can be returned to the seller who will take it back, exchange it or refund it.All complaints, requests for exchange or reimbursement must be made by post to the following address:
S.A.R.L. MENS CLUB, 60, Avenue Philippe Auguste - 75011 Paris within thirty days of delivery.

Responsibility 
The seller, in the online sales process, is only bound by an obligation of means; it cannot be held liable for damage resulting from the use of the Internet, such as loss of data, intrusion, 
Personal data 
In accordance with the law relating to data processing, files and freedoms of January 6, 1978, information of a nominative nature relating to buyers may be subject to automated processing.
 MENS reserves the right to collect information on buyers, including by using cookies, and, if it wishes, to transmit the information collected to commercial partners. Buyers can oppose the disclosure of their contact details by notifying MENS. 
Similarly, users have the right to access and rectify data concerning them, in accordance with the law of January 6, 1978. 
The automated processing of information, including the management of the e-mail addresses of users of the site was the subject of a declaration to the CNIL on 01/12/2011.

Archiving - Proof 
MENS will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code and article L 217-4 of the consumer code relating to the conformity of a product ..
The computerized registers of MENS will be considered by the parties as proof of communications, orders, payments and transactions between the parties.

Litigation
These online sales conditions are subject to French law. In the event of a dispute, jurisdiction is assigned to the competent courts of
Paris, or to the court of the complainant's domicile or to any recourse to the consumer mediator (articles L 614-1 to L 614-5 of the Consumer Code) notwithstanding plurality of defendants or warranty claim.
